1. LEGAL NOTICE

1.1. Owner Identification

In compliance with applicable information society services legislation:

  • Platforms: Android, iOS, Web

1.2. Purpose and Scope of Application

This Legal Notice regulates the use of the Whataplace mobile application (hereinafter, «the Application»). Access to and use of the Application implies express and unreserved acceptance of all the terms of this Legal Notice.

Whataplace is an application that allows users to:

  • Save and organize visited or future places
  • Add photos, descriptions and contact data to each place
  • Search for points of interest using third-party services (Google Places, Wikipedia, OpenStreetMap, Ticketmaster)
  • Organize places in personalized collections
  • Plan optimized routes between multiple places
  • Generate PDF albums with photos and maps
  • Export and import data in JSON format

1.3. Free Service

The Application is completely free. There are no in-app purchases, paid subscriptions or advertising. All users have complete access to all features at no cost.

1.4. Usage Requirements

To use the Application requires:

  • Mobile device with Android 6.0 or higher, iOS 13.0 or higher, or modern web browser
  • Internet connection to load maps and search for new places (saved data is available offline)
  • Location permissions (optional, improves experience)
  • Camera and storage permissions to add photos (optional)

1.5. Intellectual Property

All Application content (source code, design, logos, text, graphics, icons) is property of Eduardo Revilla Vaquero or used under license.

Third-party Content:

  • OpenStreetMap: Map and geocoding data under ODbL (Open Database License)
  • Wikipedia: Articles and photos under CC BY-SA 3.0 license
  • Google Places: Commercial place data (use permitted under Google terms)
  • Ticketmaster: Event data (use permitted under Ticketmaster terms)
  • OpenWeatherMap: Weather data (free use within limits)
  • Ionicons: Icons under MIT license

User Content: Users retain all rights to photos, texts and content they upload to the Application. As it is local storage, this content is not transmitted or stored on external servers.

1.6. Liability and Limitations

The Application is provided «as is» and «as available». The developer does not guarantee:

  • Uninterrupted availability of third-party services (Google Places, Wikipedia, OpenStreetMap)
  • Accuracy of location data, addresses or place information
  • Precision of calculated routes or estimated times
  • Availability of the Application in all geographic regions

The user is responsible for:

  • Making backups of their data using the export function
  • Content (photos, texts) added to saved places
  • Verifying accuracy of addresses and coordinates before navigating
  • Using the Application legally and respectfully

The developer is not responsible for:

  • Data loss due to uninstallation, device failure or lack of backup
  • Errors in third-party data (incorrect addresses, outdated information)
  • Inappropriate use of the Application (navigating while driving, etc.)
  • Compatibility issues with unsupported devices

2. PRIVACY POLICY

2.1. Data Controller

In compliance with applicable data protection regulations, including GDPR (EU Regulation 2016/679):

  • Purpose: Personal use application without personal data collection

2.2. Fundamental Principle: Privacy by Design

Whataplace DOES NOT collect, store or transmit user personal data to external servers.

The Application is designed with the «privacy by design» principle:

  • All data is saved ONLY on the user’s device
  • Does not require user account or registration
  • No proprietary servers storing information
  • No personal data sent to third parties
  • User has complete control over their data

2.3. Locally Stored Data

The Application stores on the user’s device:

  • Saved places: GPS coordinates, addresses, titles, descriptions, phones, websites, categories, dates
  • Photos: Images captured or selected by the user
  • Collections: Names, icons, colors, descriptions of created collections
  • Preferences: Chosen language, dark mode on/off, backup configuration
  • Automatic backups: JSON files in local device folder

Storage technologies:

  • Capacitor Preferences (Android SharedPreferences / iOS UserDefaults)
  • Capacitor Filesystem (device internal storage)
  • localStorage (web version)

2.4. Use of Third-Party Services

The Application connects to external services for specific functions. These services may collect data according to their own privacy policies:

2.4.1. Google Places API

  • Use: Search for restaurants, hotels and other commercial places
  • Data sent: GPS coordinates of searched location, place type
  • Data NOT sent: User identity, email, phone
  • Privacy policy: https://policies.google.com/privacy

  • Use: Search for cultural events (concerts, theater, sports)
  • Data sent: GPS coordinates, search radius
  • Data NOT sent: User personal data

2.5. Requested Permissions

The Application may request the following permissions (all optional with specific purposes):

Android:

  • ACCESS_FINE_LOCATION: Get precise GPS location to center map on your current position
  • ACCESS_COARSE_LOCATION: Approximate location as alternative
  • CAMERA: Capture photos of places
  • READ_EXTERNAL_STORAGE: Select photos from gallery
  • WRITE_EXTERNAL_STORAGE: Save photos and exports
  • INTERNET: Load maps and search places (mandatory)

iOS:

  • NSLocationWhenInUseUsageDescription: Location while using the app
  • NSCameraUsageDescription: Camera access for photos
  • NSPhotoLibraryUsageDescription: Photo gallery access

Important: If you deny these permissions, the Application continues to work but with limited functionality (you can’t add photos, it won’t automatically center on your location, etc.).

2.6. User Rights

Since all data is stored locally on your device, you have absolute control:

  • Right of access: You can view all your data anytime in the app
  • Right of rectification: You can edit any saved place
  • Right of erasure: You can delete individual places or uninstall the app to erase everything
  • Right of portability: You can export all your data in standard JSON format
  • Right of limitation: You can deny location, camera, etc. permissions anytime

2.7. Data Security

The Application implements the following security measures:

  • Secure local storage: Data is saved in device internal storage, protected by operating system
  • No transmission of sensitive data: Photos, titles, descriptions and personal data never leave the device
  • Mandatory HTTPS: All connections to external services use HTTPS encryption
  • Encrypted backups: Automatic backups are saved in JSON format on device

Recommendation: Configure automatic backups and save JSON exports in a secure place (encrypted cloud, external disk) to avoid data loss.

2.8. Use of Cookies and Similar Technologies

The mobile application DOES NOT use cookies.

The web version may use:

  • localStorage: To save place data and preferences locally in browser (equivalent to Capacitor Preferences)
  • These technologies DO NOT track the user nor are shared with third parties

2.9. Changes to Privacy Policy

This Privacy Policy may be updated occasionally. Changes will be notified by updating the «Last updated» date at the beginning of this document. Continued use of the Application after publication of changes constitutes acceptance of such changes.


3. JURISDICTION AND APPLICABLE LAW

This Legal Notice and Privacy Policy are governed by applicable law in the user’s jurisdiction. For resolution of any dispute, parties submit to the courts and tribunals of the user’s domicile.

Applicable regulations include:

  • GDPR (EU Regulation 2016/679)
  • California Consumer Privacy Act (CCPA) where applicable
  • Other applicable data protection laws in user’s jurisdiction
